The Pennsylvania Cyber Charter School won a court battle Thursday with the Slippery Rock Area School District over state funds.
The state Commonwealth Court ruled that Slippery Rock was obligated to fund a kindergarten program for a 4-year-old enrolled in the Cyber Charter School. Slippery Rock had objected to the payment, which had been deducted from its state subsidy, on the grounds that the Public School Code does not require education until a student reaches 6.
The district's discretionary kindergarten program is available only to students who are at least 5, according to the opinion.
In the opinion, the court stated that a local school district is obligated to fund educational programs offered by charter schools which the district has decided not to offer in its own public schools.
